Certificate of Need (CoN) is a regulatory process that heavily restricts Kentucky's healthcare markets. By requiring new entrants into the market to receive approval from both the state and pre-existing providers. It is akin to Lowes being required to receive Home Depot's approval before opening a new store.
By artificially limiting supply, costs have risen, quality of care has decreased, and Kentuckians have less access to care. Some states have fully repealed their CoN laws, and others have significantly reformed them. Kentucky must act soon so that we do not fall farther behind our neighbors.
Kentuckians need help. 145,000 Kentuckians suffered from opioid use disorder between 2021 and 2022. Over half a million Kentuckians have been unable to receive care for opioid use disorder. Just this year we have seen counties who have lost ambulance services due to CoN. Our Commonwealth has a severe lack of beds when it comes to psychiatric care.
For these reasons and many others, I am asking that you support reforming Kentucky's CoN laws. A few areas where we could see massive improvement are:
- Repeal the CoN on EMS services
- Repeal the CoN on Birthing Centers
- Repeal the CoN on Psychiatric Care Services
- Repeal the CoN on Chemical Dependency/Drug Rehabilitation Services
- Remove the CoN on MRI and Pet Scan Services
- Raise the minimum on medical expenditure to at least 5 million dollars
